1. Information about the processing of personal data

Your data security is important to us, and we are therefore committed to handling your personal data in a responsible manner. Below you can read how Bang & Jensen Group ApS (hereinafter "Bang & Jensen Group", "we", "us" or "our") process personal data about you when we act as data controller. You can also read about your rights in relation to our processing.

2. Bang & Jensen Group's role as data controller

In the course of running our business, we process a number of personal data. We do this so that we can provide you with the best possible service. We mainly collect and process general (non-sensitive) personal data.

3. What personal data we collect and the purpose

We process personal data about you in a number of different situations when you access our website. Read more about our processing in the different situations below.

3.1. visitors to Bang & Jensen Group's websites and users of Bang & Jensen Group's online services

When you visit the Bang & Jensen Group website (e.g. www.bangjensengroup.com) or use our other online services (e.g. Instagram, LinkedIn, Facebook, Twitter and YouTube etc.), Bang & Jensen Group may process information about your IP address as well as information about your computer, device and browser.

We also process information about your visit (e.g. information about the way you enter our websites, how you navigate around them, which pages you visit, content you look at, your searches, advertisements you have seen, etc.) This personal data is collected through log files and other technologies.

We use your personal data to enable us to make relevant benefits and services ("Services") available to you and to improve your experience of our websites and online services and the Services we offer. We also use the personal data to show you content on our and other sites based on your activities and preferences and to limit the number of times you see the same content.

Our basis for processing is our legitimate interests (GDPR Article 6(1)(f)) or your consent (GDPR Article 6(1)(a) and Cookie Order § 3).

We store personal data collected in connection with your visit to our website for up to 2 years depending on the specific data collection. See our cookie policy in this regard.

3.2 Potential customers of Bang & Jensen Group

When you as a potential customer fill in a form with your contact details on our website, Bang & Jensen Group processes the personal data, including for example name, email and phone number, that you provide to us.

We process your personal data for the purposes of contacting you with further information about the Services, statistics, quality management and general service.

Our basis for processing is the agreement with you (GDPR Article 6(1)(b)) or our legitimate interests (GDPR Article 6(1)(f)).

For potential customers, the data is stored for 1 year after the last contact with a potential customer to ensure that the dialog is only deleted when it is not relevant for a potential collaboration.

3.3 Bang & Jensen Group customers

When you are a customer, Bang & Jensen Group processes personal data about your name, e-mail, phone number, your purchases, payment information as well as information from publicly available sources and other information you provide to us - e.g. in connection with your purchase of our Services and other related situations.

We process the personal data for the purpose of fulfilling the agreement with our customers, to provide the Services, invoicing, statistics and quality management, as well as to maintain our customer records and provide general service.

Our basis for processing is the agreement with you (Article 6(1)(b) of the GDPR) or our legitimate interests in managing your data as our customer (Article 6(1)(f) of the GDPR).

We store information on our customers for 5 years after the end of the customer relationship until the end of a financial year in accordance with the requirements of the Danish Bookkeeping Act.

3.4. Marketing of Bang & Jensen Group

Recipients of newsletters

When you receive marketing from Bang & Jensen Group, we process personal data about your name, phone number/mobile number, email address and product interest. We also process information about your preferences in relation to marketing or communication and your use of the marketing we send you (including e.g. whether you have opened an email from us, whether the email has been read and which links you have opened) and information that you otherwise provide to us.

We process your personal data for the purposes of marketing our company and its Services, creating and managing you as a marketing subscriber. We use the personal data about your preferences and usage to understand the way our subscribers receive our marketing and to improve marketing to you and our other subscribers in the future.

We only send marketing material to you by email, text message or other electronic channel when we have obtained your consent to do so, when this is required under the rules of the Danish Marketing Practices Act.

We also use personal data about you to show you content on our and other sites based on your activities and preferences, to limit the number of times you see the same content, and to measure the effectiveness of our content and marketing.

Our basis for processing is our legitimate interests (GDPR Article 6(1)(f)) and/or your consent (GDPR Article 6(1)(a) and Marketing Act § 10 and Cookie Order § 3).

Data collected in connection with your subscription to our newsletter will be deleted when your consent to receive newsletters is withdrawn, unless we have another basis for processing the data.

In accordance with the Consumer Ombudsman's guidelines and requirements, we keep documentation of your consent to send you marketing material by email until two years after we have last used your consent.

3.5 Other general purposes of processing

We may enrich the personal data described above with information from other sources. This may be publicly available information - including information that we obtain through commonly available sources.

Personal data obtained for the purposes described above may also be processed by Bang & Jensen Group for the purpose of compliance with laws and regulations to which Bang & Jensen Group is subject in connection with the operation of our business or to fulfill various reporting or disclosure obligations under applicable laws and regulations (GDPR Article 6(1)(c)).

If Bang & Jensen Group sells all or part of our business or sells or transfers our assets or is otherwise involved in a merger or transfer of all or a substantial part of our business, Bang & Jensen Group may transfer your personal data to the party or parties involved in the transfer as part of that transaction where permitted by law (GDPR Article 6(1)(f)).

Finally, Bang & Jensen Group may process your personal data in order to enforce or defend our or a third party's legal rights or legitimate interests, where necessary, appropriate and proportionate (Article 6(1)(c) of the GDPR).

4. Sharing your personal data with others

Bang & Jensen Group may disclose your personal data to other suppliers and/or service providers in the ordinary course of our business and to our group companies.

In connection with the use of Facebook pixels described in section 3.4, we disclose personal data to Facebook.

The use of Google Ads-Remarketing Tag and Google Analytics as described in section 3.4 involves the transfer of personal data to Google.

Bang & Jensen Group may also disclose your personal data to a public authority in situations where we are specifically obliged to disclose your personal data pursuant to legislation and notification obligations to which we are subject.

We try to limit the disclosure of data in personally identifiable form and thus the disclosure of information that can be attributed to you personally.

Bang & Jensen Group also transfers your personal data to data processors when this is a prerequisite for fulfilling the purpose. This happens, for example, when hosting our website and other features on the website such as the Home Selector function. Our data processors only process your personal data for our purposes and on our instructions.

5. Transfer of personal data to countries outside the EU/EEA

In connection with our processing of your personal data, we may transfer the data to countries outside the EU/EEA.

Data protection legislation in these countries may be less stringent than in Denmark and the rest of the EU/EEA. However, in some countries, the European Commission has determined that the level of data protection is equivalent to the level of protection in the EU/EEA. If we transfer personal data to countries where this is not the case, the transfer of your personal data to these countries outside the EU/EEA will be based on the standard transfer contracts drawn up by the European Commission, which are specifically designed to ensure an adequate level of protection.

6. Retention period, data integrity and security

Your personal data will not be kept longer than necessary to fulfill the purposes for which it was collected. When your personal data is no longer necessary, we will ensure that it is deleted in a secure manner.

It is our policy to protect personal data by taking adequate technical and organizational security measures.

Information security is the most prioritized business risk in Bang & Jensen Group. We work seriously and professionally with information security and are based on internationally recognized security standards - including ISO 27001/2. We have implemented security measures to ensure data protection for all personal data we process. We regularly conduct internal follow-ups on the adequacy and compliance of policies and measures.

7. Your rights

As a data subject, you have a number of rights under the General Data Protection Regulation. If you want to exercise your rights, please contact us.

You can - unconditionally and at any time - withdraw any consent. This can be done by sending an email to us (see email above). Withdrawing your consent will not have any negative impact. However, it may mean that we will not be able to fulfill specific requests from you in the future. Withdrawal of your consent will not affect the lawfulness of processing based on consent before its withdrawal. Furthermore, it will not affect any processing carried out on any other lawful basis.

You can also - unconditionally and at any time - object to our processing when it is based on our legitimate interest.

Your rights also include the following:

Right of access: You have the right to access the personal data we process about you.

Right to rectification: You have the right to have inaccurate personal data about yourself rectified and incomplete personal data completed.

Right to erasure (right to be forgotten): In special cases, you have the right to have personal data about you erased before the time when we would normally erase your personal data.

Right to restriction of processing: In certain cases, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, we may in future only process the personal data - except for storage - with your consent, or for the establishment, exercise or defense of legal claims, or for the protection of a person or important public interests.

Right to object: You have the right to object to our processing of your personal data in certain cases, and always if the processing is for direct marketing purposes.

Right to data portability: In certain cases, you have the right to receive your personal data in a structured, commonly used and machine-readable format and to have this personal data transferred from one data controller to another.
